2. Vehicle Suitability and Modifications
- Information Accuracy: You are responsible for providing accurate and complete information about your vehicle, including its make, model, year, current modifications, and any known issues, prior to any service being performed.
- Performance Enhancements: Our services may result in significant changes to your vehicle's performance characteristics. While we strive to achieve optimal results, individual outcomes may vary based on the vehicle's condition, existing modifications, and driving style.
- Legal Compliance: It is your sole responsibility to ensure that any modifications performed by Beryl Boost Performance comply with all local, state, and national laws and regulations concerning vehicle emissions, safety, insurance, and roadworthiness. Beryl Boost Performance is not responsible for any legal repercussions resulting from non-compliance.
- Warranty Implications: Performance modifications may void your vehicle's manufacturer warranty. Beryl Boost Performance will not be held responsible for any loss of manufacturer warranty or any subsequent issues arising from such modifications.
3. Pricing and Payments
- Quotations: All service quotations are estimates and may be subject to change based on unforeseen complications, additional parts required, or changes in the scope of work. We will inform you of any significant price changes before proceeding.
- Payment Terms: Full payment for services rendered is due upon completion of the work, unless otherwise agreed upon in writing. We accept various payment methods, which will be communicated at the time of service agreement.
- Deposits: For certain custom builds or extensive projects, a non-refundable deposit may be required to secure parts and allocate workshop time. This will be communicated clearly in advance.
4. Guarantees and Warranties
- Workmanship: Beryl Boost Performance guarantees the quality of our workmanship for a period defined at the time of service, typically 30 days from the completion date, against defects arising directly from our service. This warranty does not cover issues caused by normal wear and tear, abuse, neglect, further modifications by third parties, or pre-existing vehicle conditions.
- Parts: Any new parts supplied and fitted by Beryl Boost Performance are covered by the respective manufacturer's warranty. We will assist in processing warranty claims with the manufacturer, but the final decision on such claims rests with the manufacturer.
- Disclaimer: Performance tuning, by its nature, places greater stress on vehicle components. While we strive for reliability, Beryl Boost Performance cannot guarantee against the failure of existing or unrelated vehicle components post-tuning.
5. Limitation of Liability
To the fullest extent permitted by law, Beryl Boost Performance, its employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services or modifications performed on your vehicle, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the services provided shall not exceed the amount paid by you for the specific service in question.
6. Vehicle Drop-off and Collection
- Timely Collection: Vehicles must be collected within a reasonable timeframe after services are completed, as agreed upon. Uncollected vehicles may be subject to storage fees.
- Risk: Your vehicle remains at your own risk while on our premises, although we take reasonable precautions to ensure its security. We recommend you maintain appropriate insurance coverage for your vehicle.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
